CODE OF ORDINANCE

ADOPTED JULY 13, 2010

NOW, THEREFORE, BE IT ORDAINED by the Oak Island Town Council that the Oak Island Code of Ordinances is hereby amended as follows by adding the following to Chapter 14, ENVIORNMENT:

ARTICLE IV.  Beach Hazards

Section 14-141. Definitions.

The following words, phrases, and terms, when used in this article, shall have meanings ascribed to them in this section, except where the context clearly indicates a different meaning.

Beach means the area between the mean low water mark of the Atlantic Ocean and the seaward toe of the frontal dune.

Beach equipment means any personal items that aare designed or manufactured for use, or actually used, on the beach or in the adjacent tidal waters. Examples include, without limitations: chairs, lounges, umbrellas, cabanas, tents, horseshoes and stakes, kayaks, paddle vessels, sailboards, surfboards, fishing gear, sporting equipment, rafts, floation devices, beach toys, baskets, bags, towels, coolers and any other personal property items. Beach equipment shall not include municipal trash containers, signage or structures, or any items placed or permitted by a governmental agency (such as signs or protection devices for turtle nests).

Section 14-142. Holes dug on the beach are required to be attended at all times and filled prior to leaving the beach.

Section 14-143. No personal items or beach equipment may be left unattended on the beach from sunset to sunrise with the exception of the framework of tents and canopies. Canvas and fabric covers must be removed from tents and canopies left unattended from sunset to sunrise.

AMEND SEC. 14-127 AS FOLLOWS:

Sec. 14-127. Enforcement

Violation of this article shall be punishable under section 1-7, up to $500.00 fine or 20 days in jail.  Anything placed in or on sand dunes or their designated access areas or attached to posts, ropes, sand fences or signs may also be designated as litter and removed and disposed of by the town.  All persons are also notified that any person who shall be adjudged to have knowingly or willfully violated the provisions of this article may also be guilty of a class II misdemeanor as defined in G.S. 113A-126(c) and may also be subject to civil penalties as provided in G.S. 113A-126(d)(1)(2)(3) and (4).  (Ord. of 3-12-2002, ch. 5, art. 1, & 1.11)

Sec. 14-132. Additional Prohibited Activities

The following additional activities are prohibited:

a)  walking, running, playing, climbing or other pedestrian traffic of any kind or description across sand dunes except in designated access areas

b)  allowing pets to traverse sand dunes except in designated access areas

c)  placing anything in or on sand dunes or their designated access areas

d)  attaching anything to sand dune access area posts, ropes, sand fences or signs

e)  vehicular traffic of any kind or description across sand dunes except in designated access areas as authorized by the town

f)  cutting, removing, trampling or in any manner damaging dune vegetation

g)  throwing or depositing refuse onto sand dunes or their designated access areas

h)  allowng refuse to be windblown onto sand dunes or their designated access areas

i)  engaging in any other activities that reduce the stability of sand dunes and potentially decrease their storm protection value, wildlife habitat value and aesthetic value.

NCFA OAK ISLAND KAYAK FISHING CLASSIC
On Saturday October 9th the NC Kayak Fishing Association (NCFKA) will host the Oak Island Kayak Fishing Classic. The Tournament fee is $55 (if paid by Setp. 1st), if paid after Sept. 1st the fee will be $65. Divisions include Trout, Redfish, and Flounder. Registration forms, prize list, and tournament information is available at www.ncfa.com. Proceeds from this event will be used to benefit the Oak Island Sea Turtle Protection Program.
TURTLE SEASON

Nesting has begun.  If you see a sea turtle on the beach, stay back and allow her to settle and begin nesting.  Observing quietly from a distance will  not distrub her.  Police may be notified if there is a problem, otherwise report nesting site to the Recreation Department (278-5518).  The nest will be verified by staff as soon as possible.  PLEASE HELP US PROTECT ALL OF OUR WILDLIFE BY MAKING IT A HABIT TO REMOVE ALL LITTER AND TRASH FROM THE BEACH.

Also, during the Turtle Nesting Season (May 1 through November 30) NO FIRES ARE ALLOWED ON THE BEACH.
